Remember the criminal indictment of Lewis May on a fraud charge in Virginia?
The president of Little Rock's May Construction Co. is scheduled for arraignment on Dec. 4 in Stafford County Circuit Court.
You might recall that May was taken into custody on Oct. 7 by the Little Rock Police Department on an extradition warrant related to an intent-to-defraud indictment linked to a Lowe's project in Stafford, Va.
The felony indictment stems from a $453,081 claim for unpaid work by Henderson Construction Co. of Fredericksburg, Va. The company obtained a default judgment on July 20 against May Construction Co. in U.S. District Court when the general contractor failed to respond to the March 20 lawsuit.
The circumstances surrounding Henderson's unpaid work prompted a grand jury investigation that produced a Sept. 8 indictment. May is accused of billing and receiving payment from Lowe's for Henderson's work but not paying the subcontractor.
We're told three other subcontractors have similar claims in connection with the Stafford Lowe's project, which opened a year ago. These could result in additional charges.
