Harrison Bank Files Lawsuit Against Dennis Smiley

Community First Bank of Harrison filed a three-count civil suit as part of the litigation against former Arvest Bank executive Dennis Smiley Jr. on Thursday.

Attorney Jim Sprott announced the lawsuit during a status hearing in Benton County Circuit Judge John Scott’s court. The suit names Smiley, his wife Cynthia and their Design For The Home LLC as defendants.

Community First Bank claims it’s owed more than $100,000 for loans made to Design For the Home in 2004, 2007 and 2010. Officials in the civil division said Scott told them to expect several more similar civil suits filed in the coming weeks.

There were eight civil suits discussed during the status hearing, with Scott asking the various lawyers how many days they expect their cases to take to be tried and whether they wanted a bench or jury trial. Scott said his scheduling assistant was on vacation and, when she returned, dates for each trial would be decided.

Several lawyers said discovery and subpoenas would take a while to execute.
