Yarnell's Employee Sues Company for Wages, Benefits

A former employee of Yarnell Ice Cream Co. of Searcy filed a lawsuit Friday against the company to collect unpaid wages and benefits for 60 days after the company shut its doors on June 30 without notice.

Shane Habisreitinger also is seeking a class certification for his lawsuit, filed in U.S. District Court in Little Rock.

Habisreitinger said the ice cream-maker violated the Worker Adjustment & Retraining Notification Act of 1988 by not giving the company's 200 workers notice that it was going to have a mass layoff, according to the lawsuit.

Yarnell's "was required to provide at least 60 days prior written notice of the termination or notice as soon as practicable, to the affected employees, explaining why the sixty days prior notice was not given," the lawsuit said.

Yarnell's didn't pay Habisreitinger and other employees their wages or other benefits 60 days from the date of the layoff, the lawsuit said.

Habisreitinger is seeking the money and benefits that he would have received if he had worked at Yarnell's for 60 days after June 30.

Yarnell's was founded in 1932 in Searcy. It had branch operations in Arkansas, Mississippi and Tennessee, and serviced supermarket, convenience store and foodservice customers in Arkansas, Tennessee, Mississippi and parts of Missouri, Kentucky, Texas, Oklahoma and Louisiana.
