Mountain Pure Sues Over Spilled Water

Mountain Pure LLC of Little Rock is suing the manufacturer of its water and juice jugs in U.S. District Court because some of the bottles leaked.

Mountain Pure said Turner Hold-ings LLC of Covington, Tenn. — the parent company of Coleman Dairy of Little Rock — had been supplying jugs for the bottled water company without problem for some time before 2001. Then Turner started supplying Moun-tain Pure with jugs of different heights, which Mountain Pure's equipment could not seal properly, the lawsuit said.

During that time, Affiliated Foods Southwest of Little Rock, which had a contract with Mountain Pure, instead started buying bottled water and juice from other companies — including Turner, Mountain Pure said.

Mountain Pure also has named Portola Packaging Inc. of San Jose, Calif., in the lawsuit because it said Portola supplied the caps for the jugs, many of which were defective and contributed to the leaks.

As a result of the problems, Mountain Pure said it lost business, including sales to Affiliated, and the damages exceed $1 million.

Turner could not be reached for comment and Portola didn't immediately return a call for comment.
