A California real estate investor has filed suit in Washington County to collect back rent and evict a tenant in the Whole Foods shopping center at 3379 N. College Ave. in north Fayetteville.
ACF Property Management Inc. of Studio City, California, filed the suit Feb. 9 against Spa810 Fayetteville North Inc., which is led by Jason Bennicoff. ACF bought the College Marketplace Shopping Center, which is anchored by Whole Foods, for $23.3 million in 2016.
Spa810 is a local franchise of a national chain with locations in 11 states, including one in Rogers. In April 2015, it leased 1,845 SF in the shopping center that was suddenly hot thanks to the arrival of Whole Foods.
ACF attorney’s, William Clark of Fayetteville, said in the suit that Spa810 owes more than $13,000 and is unlawfully in the leased space.
ACF said it sent letters demanding payment on Jan. 12 to Spa810’s local ownership and on Jan. 26 to the corporate ownership in Scottsdale, Arizona.
