Arkansas Lawsuits Against VW Allege Fraud

Arkansas lawyers filed two lawsuits last month against Volkswagen.

The first lawsuit was filed Sept. 22 in Pulaski County Circuit Court by Dennis Shipley of Russellville and Cynthia Johnson of Little Rock. 

Shipley purchased a 2014 Volkswagen Passat, and Johnson bought a 2010 Volkswagen Jetta, both from North Point Volkswagen in Sherwood.

The two allege fraud, breach of contract, breach of express warranty, breach of implied warranty, unjust enrichment and violations of the Arkansas Deceptive Trade Practices Act. 

“Because of the concealment and/or suppression of the facts, Plaintiffs and Class members have sustained damages because they own vehicles that are diminished in value as a result of Defendant’s concealment of the true quality and quantity of these vehicles’ emissions and Defendants’ failure to timely disclose the actual emissions qualities and quantities of hundreds of thousands of Volkswagen and Audi branded vehicles,” the lawsuit states.

The lawsuit seeks class action status. It was filed by the Sanford Law Firm of Little Rock.

Plaintiffs Bill and Geneva Yousey of Benton County filed their lawsuit in the U.S. District Court’s Western District on Sept. 25. 

They say they purchased a 2012 Volkswagen Jetta Diesel in 2012. The complaint states “defendants have intentionally concealed and suppressed the material that the vehicles emit as much as 40 times the amount of pollution allowed under federal law.”

The lawsuit seeks class action status. It was filed by the Evans Law Firm PA of Fayetteville and the Hirsch Law Firm PA of Springdale.
