Asa Hutchinson III Sues Couple for Backing Out of Home DealLock Icon

Asa Hutchinson III, the governor’s son, has sued a couple for trying to renege on an agreement to buy his home in Rogers.

Hutchinson, an attorney who is representing himself, filed the suit earlier this month in Benton County Circuit Court against Shawn Paul and Lisa Haley Frenzel, who had signed a purchasing agreement March 18 to buy Hutchinson’s home on Wimbledon Way in the tony Pinnacle Country Club subdivision. The deal was supposed to close May 14.

The Frenzels agreed to buy the 3,470-SF, five-bedroom, four-bath house for $550,000; Hutchinson paid $480,000 for the house in 2010.

On March 28, the Frenzels’ real estate agent, listed as Tricia Necessary of Re/Max Real Estate Results in Bentonville, contacted Hutchinson to inform him the Frenzels were “going to terminate the contract for now” because of concerns that Shawn Paul Frenzel might lose his job. But Hutchinson’s agent, Tara Limbird of The Limbird Team, told him that a possible change in employment was not a legitimate reason to terminate the purchase contract.

On March 29, the suit said, the Frenzels had the property inspected. The next day they sent Hutchinson an “inspection, repair and survey addendum,” but it contained no list of requested repairs. They also sent Hutchinson a document terminating the contract.

Hutchinson said the Frenzels never specified any concerns related to the inspection, and he alleges in his lawsuit that their attempt to back out of the deal before the inspection suggests they were using the inspection results in “bad faith.”

Hutchinson is asking the court to enforce the Frenzels’ purchase of the home and award him costs and legal fees.
