
Remember when a federal jury in San Francisco awarded truck drivers for Wal-Mart Stores Inc. more than $54 million in damages because the retailer didn’t properly pay them for time worked?
Well, the plaintiffs’ attorneys in that case asked U.S. District Judge Susan Illston to add $86.1 million to the jury’s award.
Attorneys for Wal-Mart and the plaintiffs, however, have agreed to wait unit Illston rules on post-trial motions before a final judgment is entered. Waiting, both sides agreed, “will facilitate a single appeal and conserve resources,” according to the pleading.
Illston said she would hold off on a final judgment until 30 days after she has ruled on Wal-Mart’s post-trial motions.
The case involved Wal-Mart’s truck drivers in California, who weren’t paid for tasks involving pre- and post-trip inspections of the trucks, which each take about 15 minutes, said plaintiffs’ attorney Nicholas “Butch” Wagner of Wagner Jones Kopfman & Artenian LLP of Fresno, California.
The drivers also weren’t paid for layovers that they were required to take.
The claim period is between 2005 and 2015 and covers 839 truck drivers.
