C.R. Crawford Sues in Oklahoma AgainLock Icon

Contractor C.R. Crawford Construction LLC of Fayetteville has sued a Tulsa hotelier in Washington County Circuit Court for breach of a $7.5 million contract.

If it sounds familiar, it is because Crawford, led by President and CEO Cody Crawford, filed a similar suit against another Tulsa hotelier, Anish Hotel Group, in September 2018 over a $7 million contract. That lawsuit was dismissed at Crawford’s request by Judge Doug Martin in July.

In the latest case, filed by attorney Jason Wales of Wales & Comstock in Fayetteville, Crawford said his company agreed in December 2017 to a contract with Leisure Hospitality, led by Robert Patel of Tulsa, to build a six-story Fairfield Inn by Marriott hotel in Catoosa, Oklahoma.

The suit alleged that Crawford sent Leisure a cost adjustment in early September as the actual costs of the project were revealed, but Leisure refused to adjust the contract accordingly, as is required.

The suit did not specify how much the contract would have to be adjusted. Leisure officials did not return a call asking for comment.

Crawford’s suit also alleged that Leisure failed to make a progress payment for August that was due Sept. 14 and was withholding a “substantial” portion of payments due.
