And we thought working out was supposed to be good for your health.
Dr. Erin S. Brady said she so severely injured her thumb while working out in 2017 that she couldn’t practice dentistry at Premier Dental NWA in Fayetteville.
Brady was using a bench press when her “thumb was crushed and trapped between the metal adjusting device in the closed position for approximately two minutes,” her lawsuit said. The injury resulted in a “completely numb thumb and in her inability to use her left hand.”
Making matters worse, Brady thought her disability insurance through Berkshire Life Insurance Co. of America would cover her for $10,000 a month in the event of total disability, according to her lawsuit, which is now in U.S. District Court in Fayetteville. (Berkshire is a wholly owned stock subsidiary of and administrator for the Guardian Life Insurance Co. of America.)
Brady said in the lawsuit that Berkshire made an initial payment of $30,000, which covered three months of disability payments. But that was it.
Brady is suing Berkshire for past benefits in the amount of about $200,000. She also is asking for future and ongoing benefit payments of $10,000 a month, including the loss of income and a 3% cost-of-living benefit until she can practice again.
Brady is being represented by Matthew Lindsay of the Odom Law Firm in Fayetteville.
Berkshire said in its court filing that Brady isn’t disabled under the terms of the policies she had and denies any wrongdoing.
