An Ohio company’s two-year battle for more than half a million dollars in unpaid bills has found its way to Arkansas.
The story began back in 2010, when Composite Technologies Co. LLC of Dayton, Ohio, filed suit against Evergreen Plastics LLC of Jackson, Wyo.
According to the suit, Evergreen had ignored raw material bills from CTC that totaled $631,328.18 by October 2010.
CTC sued. The Common Pleas Court of Montgomery County, Ohio, eventually filed a default judgment in favor of CTC after Evergreen was a no-show in court.
But, CTC hasn’t been able to collect the judgment and has been firing its guns everywhere it thinks Evergreen may have an interest.
That includes Arkansas, where CTC believed Evergreen has some assets, although we couldn’t figure out exactly what they might be. CTC’s local representative, Little Rock attorney Andrew King, was no help.
King filed an affidavit of the out-of-state judgment in Pulaski County Circuit Court.
“Fundamentally, we’ve got a judgment,” said Christopher Conard, an Ohio attorney for CTC. “We’re owed a lot of money, so we’re trying to collect in places where we can get it done.”
Conard said collecting is usually an uncertain business.
“You never know what you’re going to end up with,” he said. “We’re on our fishing trip.”
