Allen West, CFO of PAM Transport Inc. in Tontitown, entered a not guilty plea Monday in Fayetteville District Court.

West, 52, is charged with third-degree battery, disorderly conduct and public intoxication, all misdemeanors, after an incident with an Uber driver in the early morning hours of Feb. 16. West is being represented by Norwood & Norwood in Springdale and has a court date scheduled for May 6.

PAM had previously declined to comment on West’s arrest. After his plea, the company did not respond to a request for a comment.

According to a Fayetteville police report, West used racial slurs and punched and spit on an Uber driver in downtown Fayetteville. The slurs West allegedly used were not specified in the report.

West was booked in the Washington County Detention Center at 1:45 a.m. and released on $1,500 bail approximately nine hours later.

The police report said an officer was on duty at 1:25 a.m. outside the VIP Club at 326 N. West Avenue in Fayetteville when an Uber driver pulled up and asked the officer to remove the passenger from his front seat.

The 26-year-old driver, who is black, told the officer the white passenger, later identified as West, spit on him and used racial slurs.

The police officer said he asked West what was going on but was unable to understand West’s slurred response. The officer said West had red, watery eyes and smelled of alcohol. The officer said he then saw West punch the driver in the face.

After witnessing the punch, the officer said he placed West under arrest and transported him without incident to the detention center. The report said the driver had a red mark and minor swelling around this left eyebrow.

West joined PAM in 1997 as the company’s director of tax. He was promoted to vice president of tax and financial reporting in 2007 and named CFO in 2013.

West earned total compensation of $755,000 in 2018, according to a proxy statement PAM filed with the U.S. Securities & Exchange Commission in March 2019.

PAM said his base salary for fiscal 2019 would be $335,140; PAM is expected to file its proxy statement for 2019 later this month.
