Legal Digest Brought Up During Smiley Sentencing

There isn’t usually a lot of levity during court hearings, especially when a defendant is there to plead guilty to something such as felony bank fraud, like Dennis Smiley Jr. did on Aug. 25.

U.S. District Judge P.K. Holmes quizzed Smiley to ascertain that he was making the decision with a clear mind and by his own volition. Holmes asked Smiley if he had consumed any drugs or alcohol in the last 24 hours and Smiley acknowledge that he had:

“Prilosec. For heartburn. That’s it.”

Considering that Smiley is likely to spend several years in federal prison, some gastric distress is understandable.

A sentencing date has not yet been scheduled.
