Whisenhunt Appeals Case Against Exxon Mobile, XTO

The investment arm of Little Rock commercial developer Joe Whisenhunt will appeal a ruling involving allegations that it was shortchanged on natural gas royalties by Exxon Mobile Corp., its subsidiary XTO Energy and other firms.

Whisenhunt Investments LLC and Whisenhunt’s other family entities filed the lawsuit in U.S. District Court in Little Rock in 2013, claiming they were owed $6.4 million.

The two sides apparently worked out settlements, which weren’t publicly disclosed, on most of that amount.

Still, about $1.4 million remained in dispute, and U.S. District Judge James Moody Jr. in July ruled in favor of Exxon Mobile and XTO.

Whisenhunt Investment has filed its notice that it will appeal the ruling to the 8th U.S. Circuit Court of Appeals.

The only issue still pending at the District Court level involves how much in attorneys’ fees are owed to Whisenhunt Investments. That hearing date has not been set.
