Airways Freight Sues OZK over Wisconsin Asset FreezeLock Icon

Airways Freight Corp. of Fayetteville filed for an injunction against Bank OZK after the bank put a hold on its account.

Airways filed the suit in Washington County Circuit Court through attorney Vicki Bronson of Conner & Winters LLP of Fayetteville after the bank notified Airways that it was freezing $215,000 of its assets at the request of the state of Wisconsin, which was trying to collect a debt it was owed.

The logistics brokerage company asked the court for a temporary restraining order and injunction to remove the hold and a declaration that Wisconsin’s levy request cannot be enforced in Arkansas.

The suit said that the Wisconsin Department of Revenue contacted the bank in early June with a Notice of Levy for $215,000 of Airways’ assets for an undisclosed debt. The bank then notified Airways on June 21 that it would freeze the money for 10 days and then, barring contrary instructions, send the money to Wisconsin.

Airways argues that Wisconsin can’t levy against its assets in Arkansas without first obtaining a legal ruling and then registering a foreign judgment in Arkansas. Airways said it has no assets in Wisconsin and doesn’t do business in the state. Bank OZK, the company said, also does not do business or hold assets in Wisconsin.
