ABF Sued by Zumba Fitness Over Stolen Truck

Zumba Fitness LLC has gotten all worked up over a shipment of goods that was stolen.

The fitness company, based in Hallandale Beach, Florida, said in a lawsuit filed in U.S. District Court in Fort Smith that ABF Logistics Inc. of Fort Smith was supposed to handle a shipment of five freight trailers of fitness DVDs and other exercise material from Miami to Orlando, Florida. The items were for a fitness convention and tradeshow.

But Zumba said it didn’t know that ABF contracted with Quick Cool Transport LLC of Hialeah, Florida, to handle the load.

The day after the shipment was picked up from Zumba, the tractor and trailer containing Zumba’s merchandise were stolen from a parking lot. Zumba said the items were valued at $465,000.

Zumba submitted its claim to ABF, but ABF offered to pay only $100,000, which it said was the maximum of the liability coverage.

That didn’t sit well with Zumba. Zumba wants the amount of the stolen items plus the court costs and other related expenses. It named ABF and Quick Cool as defendants.

ABF’s spokesman said it doesn’t comment on pending litigation. Quick Cool couldn’t be reached for comment.
