Former Glenwood mayor Billy Smith on Monday pleaded guilty to accusations that he took city-owned asphalt to resurface his private driveway and his son-in-law’s private driveway.
Smith, 72, pleaded guilty to misdemeanor theft of property and abuse of office. He was ordered to pay the city $3,000 in restitution and fined $250.
Smith was arrested in February after someone spotted private trucks on city-owned property loading the asphalt in August 2021, according to a court affidavit. The asphalt was meant for a resurfacing project on Arkansas 70.
Smith, who took office in January 2019, resigned his position.
The conviction makes it unlikely he will hold public office again. Arkansas courts have ruled that crimes of fraud, deceit, or dishonesty including misdemeanors disqualify a person from holding office under the state constitution.
The Arkansas Attorney General’s Office’s Public Integrity Division investigated the case.
