Sebastian County Sued Over Unpaid Mercury BillLock Icon

A company that tested for mercury for Sebastian County said it hasn’t gotten paid for nearly $100,000 worth of work and now has sued the county.

United States Environmental Services LLC said it provided “sampling and remediation of mercury” and air monitoring for a mercury spill in Fort Smith in 2015, according to its lawsuit, filed recently in U.S. District Court in Fort Smith.

The company said it fulfilled its obligations but hasn’t been paid the $97,154 it is owed by Sebastian County’s Department of Emergency Management.

U.S. Environmental Services is suing for breach of contract and wants the money plus interest, attorneys’ fees and court courts. Sebastian County hasn’t answered the lawsuit, and the department’s director of emergency management wasn’t available for comment.
